Hotel Booking Agreement

This Hotel Booking Agreement (the “Agreement”) is entered into by and between [Hotel name], a hotel duly organized and existing under the laws of [country or region], with its principal place of business at [address] (the “Hotel”), and [Guest name], with an address at [address] (the “Guest”), collectively referred to as the “Parties”.

Background

The Hotel is the owner and operator of a hotel located at [address]. The Guest desires to reserve a room(s) at the Hotel for a particular date(s) or period of time.

Agreement

In consideration of the mutual covenants and agreements contained in this Agreement, the Parties agree as follows:

1. Reservation

The Hotel agrees to set aside a room(s) for the Guest during the term of this Agreement, subject to availability.

2. Occupancy

The Guest agrees to occupy the room(s) during the term of this Agreement, and to vacate the room(s) upon the expiration or termination of this Agreement. The number of persons occupying the room(s) shall not exceed the maximum posted occupancy for the room(s).

3. Term

This Agreement shall commence on the date of reservation and shall expire on the date of departure, provided the Guest complies with the terms of this Agreement.

4. Payment

The Guest agrees to pay the Hotel the full amount of the Room Charge, as well as any applicable taxes, upon check-in. The Guest acknowledges that the Room Charge may be subject to change without notice.

5. Cancellation Policy

The Guest may cancel the reservation without penalty up to [number of days] days prior to the scheduled check-in date. If the reservation is cancelled within [number of days] days of the scheduled check-in date, the Guest will be subject to a cancellation fee of [percentage or dollar amount] of the Room Charge.

6. Hotel Obligations

(a) The Hotel shall provide the Guest with clean and comfortable accommodations, consistent with the standard of other hotels in the area.

(b) The Hotel shall maintain the premises and the room(s) in a safe and secure manner, in accordance with applicable law.

(c) The Hotel shall provide the Guest with information about the Hotel, the surrounding area, and local attractions.

7. Guest Obligations

(a) The Guest shall comply with all hotel rules and policies, as posted or otherwise communicated to the Guest.

(b) The Guest shall not engage in any illegal or prohibited activities on the hotel premises, including but not limited to smoking in a non-smoking room.

(c) The Guest shall be responsible for the cost of any damage caused by the Guest or their guests to the room(s) or hotel property.

8. Compliance with Law

The Parties shall comply with all applicable laws and regulations in connection with this Agreement.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [jurisdiction].

10. Entire Agreement

This Agreement constitutes the entire agreement between the Parties and supersedes all prior negotiations, understandings, and agreements between the Parties.

11. Effective Date

This Agreement shall become effective upon the Parties’ execution of this Agreement.

12. Termination

Either Party may terminate this Agreement for cause upon notice to the other Party. In the event of a termination, the Guest shall vacate the room(s) immediately upon notice.

13. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, such provision shall be severed from this Agreement and shall not affect the validity or enforceability of the remaining provisions.

14. No Waiver

No waiver of any term or condition of this Agreement shall be effective unless in writing and signed by both Parties.

15. Assignment

Neither Party may assign or transfer this Agreement or its rights or obligations hereunder without the express written consent of the other Party.

16. Headings

The headings in this Agreement are for convenience only and shall not affect the interpretation of this Agreement.
